1. Scope and Provider

These Terms and Conditions ("Terms") apply to all purchases via the online store operated by Kauffritz GmbH, Volkmarstr. 1–7 H, 12099 Berlin, Germany ("we", "us", "our"). Our contact details and legal disclosures are available in the Legal Notice.

By placing an order you agree to these Terms.

2. Conclusion of Contract

Product listings are invitations to order, not binding offers. By clicking "Buy now" you submit a binding offer. The contract is concluded when we send a shipping confirmation or dispatch the goods. We will confirm receipt of your order by email.

3. Prices, Taxes and Payment

Unless stated otherwise, prices are shown in EUR and include statutory VAT.

Shipping costs are displayed at checkout.

We accept the payment methods shown at checkout (via Shopify Payments and other providers). Charges are processed in compliance with PCI-DSS.

4. Shipping, Delivery Times and Transfer of Risk

We ship to the countries stated on the Site. Delivery time estimates are shown at checkout. For full details see our Shipping & Delivery page.

For consumers (B2C), risk passes only upon delivery to you (or a recipient you designate), not when we hand over goods to the carrier.

If an item is unavailable, we will inform you and refund payments without undue delay.

5. Retention of Title

Goods remain our property until paid in full.

6. Right of Withdrawal (Consumers Only)

Consumers have a 14-day right of withdrawal under EU and German law. Details and the model withdrawal form are provided in Annex A below. Your local legal rights are not affected.

Return handling is further explained in our Returns & Refunds page; in case of conflict, this Section 6 and Annex A prevail.

7. Statutory Warranty (Gewährleistung)

Your statutory rights for lack of conformity apply. The legal warranty period is 2 years from delivery (subject to statutory suspensions and extensions). For business customers (B2B), § 377 HGB (duty to inspect and notify defects) applies.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For simple negligence, we are liable only for breach of an essential contractual duty (Kardinalpflicht). In that case, liability is limited to foreseeable, typical damage.

Nothing in these Terms reduces mandatory consumer rights.

9. Promotions, Vouchers and Gift Cards

Promotional offers are subject to the terms stated with the offer. Vouchers and gift cards are non-transferable unless stated otherwise, cannot be redeemed for cash, and may have validity periods where permitted by law.

10. User Accounts and Use of the Services

Account security is your responsibility. Misuse of the Services is prohibited. We may restrict or terminate access for violations of these Terms or applicable law.

11. Intellectual Property

All content on the Services is protected by copyright and other intellectual property rights. Personal, non-commercial use is permitted only as allowed by law or by our written consent. Trademarks remain with their respective owners.

12. Third-Party Tools and Links

We may provide access to third-party tools and link to third-party sites at your discretion and risk. Please review the terms and policies of any third party you interact with through the Services.

13. Relationship with Shopify

Our store is hosted by Shopify. Sales contracts are concluded with Kauffritz GmbH. Shopify is not a party to your purchase contract.

14. Privacy and Cookies

Personal data are processed in accordance with our Privacy Policy and Cookie Policy. Because the Services are hosted by Shopify, Shopify also processes certain data as described in Shopify's privacy materials.

15. Alternative Dispute Resolution / ODR

The European Commission's online dispute resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr/.

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Governing Law and Jurisdiction

For consumers, the mandatory consumer protection provisions of your country of residence apply in addition to German law. Otherwise, these Terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant (B2B), the exclusive place of jurisdiction is Berlin, Germany.

17. Changes to These Terms

We may amend these Terms as required by law or for operational reasons. The current version is published on this page. For material changes affecting ongoing subscriptions or similar continuing relationships, we will provide notice as required by law.

18. Severability, Assignment, Entire Agreement

If any provision of these Terms is invalid, the remaining provisions remain in effect. You may not assign rights or obligations under these Terms without our prior written consent. These Terms, together with the policies linked from them, constitute the entire agreement for purchases via the Store.

Annex A — Instructions on Withdrawal (Widerrufsbelehrung)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party indicated by you (other than the carrier), acquired physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or by email). Use the following contact details:

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw.

We will use the same means of payment for the reimbursement that you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods unless otherwise stated on our Returns & Refunds page.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions

The right of withdrawal does not apply to, among others:

  • sealed goods which are not suitable for return for reasons of health protection or hygiene, if unsealed after delivery;
  • made-to-order goods or items clearly personalised for you;
  • goods which, after delivery, are inseparably mixed with other items;
  • and other statutory exceptions under § 312g(2) BGB.
